Article 88 n.2 - Residence Permit for Subordinate Professional Activity, with Exemption from Residence Visa

Passport or another valid travel document

  • Be aware to have all your travel documents valid within a reasonable amount of time to get all your immigration affairs sorted

Proof of regular entry into Portuguese territory (possession of a valid visa when required, or entry into Portugal within the visa exemption period).

  • Entry into Portugal is assumed legal if the applicant has been working in the national territory and has their social security situation regularized for at least 12 months.
  • If you enter without a visa, you can still register (making your situation irregular & not illegal) your entry by staying at a hotel/ motel, at the very beginning of your stay in Portugal (in the first 72 hours). Otherwise, you must pay a fine that amounts to 180€

Proof of means of subsistence, as stipulated in Decree No. 1563/2007, dated 11/12;

  • Means of subsistence are stable and regular resources sufficient for the essential needs (food, accommodation, health, and hygiene care) of the foreign citizen, and when applicable, their family.
  • These must be ensured for the number of months of the anticipated duration of the stay.
  • The criterion for determining the means of subsistence is based on the minimum monthly salary (currently 820€ per month), net of any social security deduction, with a per capita increase for each family unit as follows:
    • First adult 100%
    • Second adult and additional adults 50%
    • Children and young people under 18 years of age and non-minor dependent children 30%

Criminal record certificate from the country of origin;

  • Authenticated and translated (usually has 3 months validity)

Criminal record certificate from the country where you have been residing for more than one year (if not Portugal);

Authorization for consultation of the Portuguese criminal record by AIMA;

    Document proving that you have accommodation - 🔗 Form

    • In situations where you live there because you are the owner or usufructuary, you must submit a land registry certificate or provide the respective access code to prove ownership or usufruct rights, OR
    • In situations where you live there as a tenant or lessee, among others, a statement from the landlord of the property or the hosting entity, mentioning the legal situation underlying the right to use the property.

    Proof of registration and regularization with Segurança Social, except in the case of a promise of employment contract;

    Proof of registration with Administração Fiscal (Tax Administration);

    Employment contract (it’s only relevant to get your temporary residence card if you have a work contract - don't take jobs that don’t offer work contracts); OR

    • Declaration of the Employer attesting to the employment relationship – form can be found 🔗here
    • Promise of an employment contract concluded under the law
